Caprok.net Acceptable Use Policy
1. Caprock Internet Solutions (Caprok Internet) will provide Internet services (the service) to the customer (named on the User Sign-Up Form, Invoice, or Contract) for his/her private use. The customer (residential or commercial) must abide by this Caprok.Net Acceptable Use Policy which can be found at http://www.caprok.net/acceptle.html or is available via Email at the customer's request. Any violation of this policy may result in the suspension or termination of the account without notice, investigation by the FBI, NSA, state, or local authorities. Violators do not qualify for a refund. Use of a Caprok.Net account constitutes the understanding and acceptance of the terms and conditions set forth in this policy. In other words, if you use your account you are accepting all the terms in this policy and agree to abide by them. All new users of the service are informed that this policy exists and that it is available for viewing on this website when they sign-up for service. If you do not agree with the terms herein, log off immediatly and call 580-8848 to cancel your account.
1a. Definition of unlimited access - Log on and off as often as you like as many times as you like. Sessions are unlimited as long as they include breaks at least equal to 25% of each sessions overall time. A session is the total time spent on-line from the time you log on till the time you log off For example: An eight hour session should be followed by a break of 2 hours before the next session. A 1 hour session should have a fifteen minute break before the next session.
1b Definition of Dedicated access - Logging on and staying on for excessive long term sessions (8 hrs or more) on a continuous and regular basis with very short or, no breaks at all between sessions. You may be billed for a dedicated line without notice after one warning, and or, your account disabled.
1c Modem Ratio Definition - Put simply, the number of customers sharing a modem in our system. The National average modem ratio is 10 customers per modem. (very rare to get a busy signal) Higher ratios than 10 to 1 virtually guarantee frequent busy's for everyone. We have a no busy signal policy so we maintain a 7 to one ratio. The lowest in the Permian Basin. BUT, It only takes a few users, that insist on using their accounts as if they were dedicated lines, to destroy even our very low modem ratios. This is a violation of our policys and will result in the termination of the offending users account without notice.
1c.1. Definition of our "NO BUSY SIGNAL POLICY" - We guarantee to maintain a Modem Ratio that is sufficient to keep busy signals rare. (7:1 or better) We do not gurantee that it is an impossible occurance. (The only way to do that is give everyone their own line.) We also do not gurantee that a sudden surge of use due to a "NEWS" event will not produce busys. If our modem ratio exceeds 7:1 we guarantee that we will expand our capacity ASAP to bring our ratio back into the proper range.
WHY DO WE SET THESE POLICYS ?- Very simple. It's not to be mean or because we are greedy. This "EASY TO COMPLY WITH " policy insures that our modem ratio works for you. It also makes it possible to give you quality service at affordable prices. (As long as everyone cooperates) Busy signals are the direct result of a small percentage of customers ignoring this policy. If, for example, we were to give everyone their own line (the only SURE way to avoid a busy signal), we would be forced to set the monthly cost of your service to over $200.00. This is not very practical, therefore, every ISP has a similar policy. If not, they will very quickly be out of business. (Some ISP's policy's are far more restrictive than ours. Many ISP's in the Permian Basin, limit you to less than 150 hours per month and will bill you for dedicated service if you use their systems for as little as 6 hours per day.)
2. Caprok.Net reserves the right to modify the Acceptable Use Policy at any time. Any modifications to this policy will be dated appropriately. Caprok.Net also reserves the right to limit or discontinue any Internet service which may compromise network integrity or our modem ratios, at any time for any reason.
3. A Caprok Internet dial-up or dedicated account is personal and private and therefore does not extend to any other person(s), corporation, or entity.
4. A Caprok.Net account is non-transferable. Login names and passwords may NOT be shared with outside parties for YOUR PROTECTION.
5. No more than one dial-up connection can be used at any time for each login account. If, at any time, more that one instance of an account is detected, the account will be suspended immediately for security reasons.
5a. 64K ISDN users will be billed for 128k service for the month, if at any time during the month, they log in at 128K speeds. (pre-arranged testing excepted)
6. A residential account does not constitute a dedicated connection. An inactivity time-out of twenty minutes has been engineered in the PPP daemon to ensure fair access to all customers. Any attempt to bypass such measures is a breach of this policy; examples of such measures are: ping daemons, IRC, and mail clients set to check mail at low time intervals.
7. Any attempt to violate the security, stability or integrity of any Caprok.Net server is strictly prohibited.
8. The use of TIA and other SLIP/PPP emulators is prohibited..
9. The use of any NNTP emulator is prohibited..
10. Storage and/or distribution of pornographic materials or illegal materials (material which Caprok.Net deems threatening or obscene) on Caprok.Net's servers is strictly prohibited. This includes links to adult sites and or the inclusion of language on any hosted site that is adult or obscene (in OUR judgement) in nature. Such accounts will be suspended without notice and reported to regulating agencies or authorities and payments made to Caprok.net will NOT be refunded..
11. Tampering with the return address or route report on an e-mail message or Usenet news message is prohibited. Anonymous transmissions of any sort are prohibited. Caprok maintains a strict "NO-SPAM" policy.
12. Caprok.Net customers must abide by the terms and policies of any service to which he/she connects. Obtaining these policies is the direct responsibility of the customer.
13. Caprok.Net customers must abide by the net-wide accepted rules of Internet conduct. An example of netiquette can be found at http://www.fau.edu/netiquette/net/
14. Each PPP account is provided with 2 E-Mail accounts. Additional E-Mail accounts may purchased at a rate of $5.00 each. (onetime setup charge).
15. Each Dial-up PPP account is provided with 5 megabytes of storage space on Caprok.Net's servers for FTP, E-Mail, and WWW files. Use of storage space exceeding 5 Mb may result in an automatic charge for additional storage space at the current rate of $10.00 per megabyte per month or part thereof. (5 MB of storage space is a VERY LARGE website)
16. The customer is responsible for a basic working knowledge of his/her operating system/interface (Win 3.x, Win 95/98 NT, or MAC). Technical support representatives are not responsible for general computer support. Any technical assistance given to the customer, outside the bounds of Internet service, is at the discretion of the representative, and could result in a charge. Any PC dropped off at Caprok.Net at 810 N Dixie Suite 202D Odessa Texas for the purpose of testing, installing, OR configuring an unsuccessful attempt to get connected to Caprok.Net Internet Service will automatically be assessed a minimum of a $20.00 service charge, not including sales tax, at the discretion of the support department.
17. Caprok.Net offers free 24 hour technical support via telephone for log-on problems, E-mail issues and FTP problems only. The 24 / 7 technical support phone number is (915) 580-8848. An answering machine may be used if all support techs are busy and calls returned in the order in which they are received.. All other support or software help requests should be emailed to: [email protected] or called in during normal business hours.. Our office hours are : Monday through Friday from 9:00am to 6:00pm. CST. Saturday & Sunday office hours are from 10am to 6pm CST. Offices may be closed on most major holidays or on a Sat /Sun schedule.
18. All customers that utilize a dial-up account receive 5 megabytes of space provided for ftp and world wide web page files for either personal or commercial use.
18a Advertising your site utilizing any mass mailing or mass posting to Usenet Newsgroups or unsolicited email broadcasts is considered SPAM and is prohibited. It is also against the law and receivers of this type of email may now prosecute the sender(s). Violators of this policy may have their accounts suspended without warning.
19. The standard rate for PPP account access through Caprok.net is $19.95. The customer agrees to pay all bills, initial and recurring, by the billing date listed on the invoice. All setup fees and first month's fees are non-refundable unless the customer is unsuccessful in using the account. Bills will not be pro-rated except for the first month.. Any cancellation must be made in writing (e-mail, FAX, or U.S. Post Office Mail) and will become effective at the end of the last billing cycle. Any account which goes unpaid for more than 5 days past the due date may be assessed a late charge of $5.00 and when 10 days past due, may be suspended without notice. Returned checks including autocheck are subject to a charge of $20.00. Re-activation of suspended accounts may incur a $25.00 fee at the sole discretion of Caprock Internet Solutions. Credit card charges will appear on your statement as TKN Automotive Services. Tkn , our parent company handles all billing for Caprok Internet.
20. The customer agrees to indemnify Caprock Internet Solutions against liability for any and all use of the customer's account.
21. I understand and agree that all payments made to Caprock Internet solutions, are non-transferable and non-refundable. I understand that prorating is computed only on the first month of service. I understand that all service fees are subject to change without notice. I agree to use this service only for lawful purposes and I agree to use the Internet within compliance of all state and federal regulations, including all copyright and trademark laws and regulations governing data ownership. I agree to indemnify Caprock Internet solutions, against liability for any and all use of my account. I acknowledge and agree that Caprock Internet solutions, exercises no control over the content of the materials which may be accessed through Caprock Internet solutions, or the Internet and that certain materials accessed may be offensive and may include adult materials, themes and information. I acknowledge and agree that I am solely responsible for any information and materials retrieved or viewed by any person, adult or child, who accesses the Internet through my account with Caprock Internet solutions, I hereby release and discharge Caprock Internet solutions, and its employees, managers, members, agents, officers, directors, insurers, and assigns from any and all causes of action which I may have arising from the information or materials which I access or obtain by using Caprock Internet solutions, to access or retrieve such information, services or materials from the Internet including any type of virus which might damage any software, hardware or any data stored on any computer from which I am accessing the Internet through my account with Caprock Internet solutions, Caprock Internet solutions, reserves the right to refuse service to anyone. Caprock Internet solutions, reserves the right to terminate service to any subscriber without notice for any activity deemed inappropriate. Caprock Internet solutions, STRONGLY advises all parents to supervise the materials and information their children access through the Internet. Furthermore, Caprock Internet solutions, neither recommends nor evaluates ANY site on the Internet for content suitable to you or to your child's needs. I , the account holder, certify that I am (18) years of age or older and that by accessing the Internet through Caprock Internet solutions, I am also certifying that I understand and agree to all the Terms and Conditions set forth on this document. I also agree to view this document on a regular basis for any changes herein.
